What to know before filing for divorce

There are certain steps to take and things to understand before one decides to file for divorce. Understanding the process of divorce can help ease worries and better prepare an individual for what to expect. When a couple has minor children or owns property together, that can add challenges that can make the divorce contentious. But even the most amicable divorces can lead to disagreements. Understanding the legal side of divorce can make one feel better prepared to file the initial paperwork.

The first step is to file the divorce petition. The petition should establish residency of at least one of the parties in the state in which the petition is filed. It should also include a legal reason for the divorce and other information required by the state. The petitioner may also file for temporary court orders related to child custody and support. Then, the other party must be served with the documents, at which point, they file a response. 

Everyone deals with the emotional side of divorce differently. It’s important to have realistic expectations of the process and to understand that many divorces take 12-18 months to finalize. During that time, hard decisions must be made, especially if there are children involved. Some couples can use mediation or other arrangements to come to an agreement. Others will need to have a court decide for them.
